NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE, that pursuant to pursuant to Article VIII of Chapter 230 (Zoning) of the Code of the Village of Dering Harbor and N.Y. State Village Law §7-712(b), the Board of Appeals of the Village of Dering Harbor will hold a public hearing on Saturday, September 13, 2025 at 8:00 a.m. prevailing time, at the Dering Harbor Village Hall, Locust Point Road, Dering Harbor, New York, to hear any and all persons either for or against the following application:
- Application of BRANDON ROSE for (A) an interpretation pursuant to the provisions of §230-9C to confirm the designation of the front lot line, side lot lines and the rear lot line and the corresponding yards; to wit: the westerly lot line along Dering Harbor is the front lot line/yard; the northerly and southerly lot lines are the side lot lines/yards; and the easterly lot line is the rear lot line; and (B) variances from the provisions of (1)§230-21A(3) and §230-21B(4) in order to permit the modification and expansion of an existing nonconforming driveway and parking area with an existing 4’ setback where a driveway must be setback 25’ and a parking area setback 30’; (2) §230-36 in order to permit the of an enclosed porch on the westerly side of the existing dwelling with a side yard setback of 17.1’ measured from the northerly property line where 30’ is required; (3) §230-9B(7) and §230-36 & 37 in order to permit the construction of a 23.9’ by 36.9’ two-car, one-story garage with full basement with a side yard setback of 4.2’ measured from the southerly property line and an 8.0’ rear yard setback measured from the easterly property line where 30’ is required; (4) §230-9B(7) and §230-37 in order to permit the construction of a basement egress window well attached to the proposed garage with a rear yard setback of 5.6’ measured from the easterly property line where 30’ is required; (5) §230-9B(7) and §230-37 in order to install a new HVAC condenser(s) and pad along the easterly side of the proposed garage with a setback of 8.0’ measured from the easterly property line where 30’ is required; (6) §230-9B(7) and §230-37 in order to replace an existing spa with a setback of 11.5’ measured from the easterly property line where 30’ is required; and (7) all other necessary relief as shown on the survey and plans submitted with the application, on a nonconforming 26,593 sq.ft. parcel of land located on the easterly side of Dering Harbor at the northerly terminus of a private right-of-way, approximately 103’ north of Harbor Lane in the B-Residential District known as 23 and 23A Harbor Lane and designated as SCTM#s 0701-001.00-01.00-001.000 & 004.000.
