VILLAGE OF DERING HARBOR
BOARD OF TRUSTEES MEETING
April 15, 2017

In Attendance: Mayor Timothy M. Hogue
Trustees: Heather E.G. Brownlie, Esq.; John Colby and Richard Smith.
Village Attorney: Joseph W. Prokop, Esq.
Village Residents: Marian Brownlie, Esther Hunt, Bridgford A. Hunt, Rob Ferris,Karen Kelsey,

Patrick Parcells, James Goldman, Susannah Rose and Michael Kostow.
Also Present:    Julia Brennan for the Shelter Island Reporter, Gail Donenfeld and Judy Card of Binder Pools representing the Crosses.

Public Hearing on Proposed Budget FY 2017-2018

Mayor Hogue opened the Public Hearing on the Proposed Budget for FY 2017-2019 at 10:10 a.m. Review of the Tax Rates for the past three years in terms of the total budget amount and tax rates. No salary increases in the proposed budget. Bond debt will be retired at the end of the next fiscal year. Water Tank expenditures will be reflected in the next budget. Public comment on specific
line items. Motion by Richard Smith with a second by John Colby to close the Public Hearing on the budget. Motion carried unanimously.

Public Hearing on Local Law Authorizing a Property Tax Levy in Excess of the Limit Established in General Municipal Law Section 3-c

Mayor Hogue opened the Public Hearing on the Tax Cap Legislation at 10:29 a.m. Recommended that municipalities pass this type of legislation annually whether or not budget would exceed the
allowable limit otherwise penalties if exceed the prescribed increase amount. No comments from the public. Motion by Richard Smith with a second by John Colby to close the Public Hearing on the Tax Cap Legislation proposed. Motion carried unanimously.

I.   Mayor Hogue opened the Trustees meeting at 10:33 a.m.

II.  Review of the Minutes from the March 18, 2017 Meeting.

A. Motion to approve the Minutes from March 18, 2017 made by Richard Smith with a second by John Colby. Motion carried unanimously.

III. Review of the Bills from March 2017

IV. OLD/NEW BUSINESS

A. Resolution Regarding Adoption of a Local Law Authorizing A Property Tax Levy in Excess of the Limit Established in General Municipal Law Section 3-c

1. Motion to adopt lead agency status for purposes of SEQRA and to declare the resolution a Type II Action for purposes of SEQRA and to adopt a negative declaration that the proposed legislation will not have a negative impact on the environment made by Richard Smith with a second by John Colby. Motion carried unanimously.
2. Motion to approve the Adoption of a Local Law of 2017 Authorizing a Property Tax Levy in Excess of the Limit Established in General Municipal Law Section 3-c made by Richard Smith with a second by John Colby. Motion carried unanimously.

B. Water Tank Progress Report

1. Bids received for Water Tank ? lowest bid was unresponsive
2. Bid from Statewide Aquastore Inc. for $498,820 was the bid to be accepted
3. Funds will be received in advance from New York State to pay for tank
4. Next step is to negotiate a contract with the responsive bidder
5. Motion by John Colby with a second by Richard Smith to determine that the  low bid was non-responsive and to select the bid from Statewide Aquastore Inc.  and pursue negotiations to enter into a contract. Motion carried unanimously.
6. Motion by Richard Smith with a second by John Colby authorizing Mayor  to execute a contract with Statewide Aquastore Inc. for $498,820. Motion  carried unanimously.

C. Cross Application for Swimming Pool Fence

1. A portion of the hedge is situated on property owned by the Village
2. A License Agreement has been proposed to allow the hedge to remain
3. Trustees have reviewed the fence application and location of the hedge
4. Motion by Richard Smith with a second by John Colby to approve the Fence Application contingent upon obtaining a signed License Agreement for the  hedge and to refer the matter to the Architectural Review Board.  Motion carried unanimously.

D. Article in the Shelter Island Reporter regarding Transparency of Municipalities Karl Grossman column wrote an article on municipal transparency on east end The Village of Dering Harbor received an A+ rating while others much lower.

E. Update on Court Proceedings

1. The judge in the litigation against the Village has ruled on the Motion to Dismiss.
2. Additional Parties must be added for the suit to be resumed.

V.  Date for next meeting set for May 20, 2017 at 10:00 a.m.

VI. Motion to adjourn the Trustees Meeting made by Richard Smith with a second by Heather Brownlie. Motion carried unanimously.
