Section 1.0 Title, Enactment, Effective Date, Purpose, and Definitions
1.1 Title
This Local Law shall be entitled “Local Law No.1 of 2016 of the Incorporated Village of Dering Harbor, a Local Law Adopting Regulations Regarding Permitted Construction in the Village of Dering Harbor”
1.2 Enactment
Pursuant to Section 10 of the Home Rule Law and the Village Law of the State of New York the Incorporated Village of Dering Harbor, County of Suffolk and State of New York, hereby enacts by this Local Law of 2016, a Local Law of the Village of Dering Harbor.
1.3 Effective Date
This local law shall take effect upon the filing of the approved Local Law with the Secretary of State of New York, which shall be within twenty (20) days after its approval by the Board of Trustees of the Village of Dering Harbor.
1.4 Findings
The Board of Trustees of the Village of Dering Harbor determines and finds that it is in the best interests of the Village, its residents, property owners and guests, and of the preservation of good order and public safety in the Village of Dering Harbor to prohibit construction during certain hours each day and week.
1.5 Purpose and Intent of Local Law.
The purpose and intent of this Local Law is to protect the safety and well-being of the residents of the Village and their guests and families as well as the atmosphere and peace and tranquility of the Village by prohibiting permitted construction in the Village of Dering Harbor during designated times as stated in this Local Law.
2.1 Construction During Designated Times Prohibited.
It shall be and hereby is prohibited for any person or party to perform construction on any building or structure for which a building permit or similar municipal approval has been issued except as follows:
Monday-Friday 8:00 A.M. – 6:00 P.M.
Saturday -No Construction Permitted
Sunday -No Construction Permitted
3.0 Violations. Penalties and Fines
There shall be a fine or penalty of not more than two hundred and fifty dollars ($250} for each and every violation of this local law, and each day that a violation shall exist shall be a separate violation of this Local Law. The owner of the property on which the violation occurs and the contractor or other party that was performing the prohibited construction shall both have committed an act in violation of this Local Law.
4.0 Severability.
In the event that any section or portion of this Local Law shall be deemed to be unenforceable or of no effect, the remainder of the Local Law shall survive and remain in full force and effect.
